Eligibility and Transferability

This structural warranty is exclusively for the original purchaser, is non-transferable, and is valid only under the following conditions:

1. The original installation was performed by a duly authorized independent installer of Pools for Africa, a licensed contractor, or the original buyer who complies with South African local building codes and Pools for Africa’s installation procedures.
2. Pools for Africa has received full payment for the pool.
3. The purchaser notifies Pools for Africa within 10 days of discovering a warranty issue, specifying the exact nature of the problem.
4. The purchaser agrees to cooperate with Pools for Africa and allows access to the pool area during normal business hours for repairs.

Structural Warranty

Pools for Africa guarantees its fibreglass pool shell to be structurally sound for 15 years. “Structurally Sound” means the pool is capable of holding water. If the pool fails to contain water, Pools for Africa will repair it to ensure it does. Repairs may involve modifications to the pool. Pools for Africa will not compensate for loss of time, pool use, inconvenience, or the cost of refilling the pool with water.

Surface Repairs

All surface repairs must be conducted by Pools for Africa or authorized personnel, using the same color materials as the original pool shell. However, an exact color match is not guaranteed, and slight color variations may occur.

Exclusions

The coping/paving is not covered under this warranty.

Installation Requirements

A minimum 10:1 clean sand and cement backfill mix must be used to validate the warranty. All installation specifications prescribed by Pools for Africa must be fully complied with.

Surface Warranty

This warranty includes a 6-month repair period for hairline cracks, gel coat chips, and blistering. After 6 months, the warranty excludes discoloration, staining, fading, hairline cracks, blistering, gel coat chips or cracks, surface yellowing, or roughness.

Maintenance Exclusions

Poor maintenance resulting in algae infestation, calcium scale, mineral deposits, or faults from misuse or incorrect water balance is not covered.

Equipment and Material Exclusions

The warranty does not cover pipe fittings, skimmer, inlet fittings, light niche, or any other equipment/materials connected to the pool. Equipment such as filtration systems, pumps, and motors are covered by their individual manufacturer warranties.

Determination of Fault

Pools for Africa will determine the cause of any structural fault, whether it is due to their own actions, an installer/contractor, or another cause.

Installation Responsibility

Pools for Africa is not responsible for shell problems resulting from incorrect installation.

Repair or Replacement

Pools for Africa will decide whether to repair or replace the pool in case of a major structural fault. Pools for Africa is not liable for any property damage, including fences, shrubbery, walks, trees, patios, water, or other improvements, except in cases of gross negligence.

Exclusive Warranty

This warranty is exclusive and replaces all other warranties, written, oral, or implied. It cannot be altered without the written consent of pools for africa. Pools for africa is not responsible for any consequential, incidental, or special damages resulting from a breach of this warranty, including loss of pool use, time, or inconvenience.

Fit for Purpose

The warranty guarantees the pool’s structural integrity under normal and natural ground conditions for the full term.

Warranty Voiding Conditions

The warranty will be voided if any of the following conditions occur:

1. The pool must remain full of water at all times. Damage may occur if the water level drops below the skimmer outlet.
2. Damage and separation from the concrete decking may occur if the pool is allowed to overflow or if heavy water drainage runs into the pool shell. Maintain the water level in the middle of the skimmer.
3. Prevent runoff water from entering the pool area to avoid hydrostatic pressure or bulging.

This warranty applies to authorized pool builders who are members of the Cape Town Pool Builders Association and APSP SA. It remains in effect until terminated by Pools for Africa.
